ED Challenges Arvind Kejriwal’s Bail in Liquor Scam Case; Delhi High Court to Hear Plea on May 8

New Delhi: The legal troubles of Arvind Kejriwal, former Delhi Chief Minister and national convenor of the Aam Aadmi Party, are set to intensify as the Enforcement Directorate (ED) has moved the Delhi High Court seeking cancellation of the bail granted to him in the Delhi liquor policy-linked money laundering case.

The High Court on Wednesday heard preliminary arguments on the ED’s plea and scheduled the matter for detailed hearing on May 8. The bench also directed that records of the trial court be summoned for examination.

Why ED Approached the High Court Now

According to sources, the ED has argued that the trial court failed to apply the strict legal standards prescribed under the Prevention of Money Laundering Act (PMLA) while granting bail. The agency has maintained that such an approach weakens the statutory powers of the ED and sets an incorrect legal precedent in cases involving serious economic offences.

The ED further pointed out that the interim bail granted by the Supreme Court of India in July 2024 cannot be treated as permanent relief. Crucially, the apex court had referred three important questions on the necessity and legality of arrest under PMLA to a larger bench, which are still pending adjudication.

Courtroom Developments

During the hearing before Justice Swarnakanta Sharma, counsel appearing for Kejriwal sought an adjournment, citing the unavailability of senior advocates. The court declined an immediate pass-over and fixed May 8 as the next date of hearing, clarifying that the matter would be examined in detail on that date.

Background of the Case

  • March 21, 2024: Kejriwal was arrested by the ED in the money laundering case linked to the now-scrapped Delhi excise policy.
  • June 26, 2024: The Central Bureau of Investigation (CBI) arrested him in a related corruption case.
  • July 12, 2024: The Supreme Court granted Kejriwal interim bail in the ED case and referred key legal questions under PMLA to a larger bench.
  • Subsequently, the Delhi High Court stayed the trial court’s bail order, though it did not formally cancel the bail.

What Lies Ahead

With the ED now pressing for outright cancellation of bail, May 8 is expected to be a crucial date in the case. The High Court’s decision could significantly impact Kejriwal’s legal position and shape future interpretation of bail provisions under PMLA.

Whether the court tightens the legal noose or grants Kejriwal continued relief remains to be seen.
